This article examines the current problems and tension that characterize the idea of the right to have rights, considered as a cornerstone of the European Union's project. The systemic deficit matter is discussed as the main problematic to achieve the entirety of the previous concept, and some systemic deficit profile are identified. Moreover through the example of the Greek experience the article shows a possible way of common action to solve the systemic deficit. Die naivsten Formen der Argumentation sind nicht schlüssig; in ihrer weiteren Verwendung und Diskussion ist sie daher in drei unterschiedHchen Richtungen modifiziert worden: durch sprachtheoretische Ergänzungen , zu ad hominem-Strategien sowie zu quasi-transzendentalphilosophischen Varianten.

The object of our investigation is expressing necessary conditions in natural language, particularly in a certain kind of conditional sentences, the so-called Anankastic Conditionals 2, a topic brought into the linguistic discussion by the seminal papers and. A typical AC is the following sentence, Sæbø’s standard example: If you want to go to Harlem, you have to take the A train. Sæbø analyses the sentence by means of the modal theory in, according to which a modal has two contextual parameters, (...) a modal base f and an ordering source g. The modal base contains relevant facts and the ordering source contains an ideal like wishes, moral laws and the like. Normally, the antecedent of a necessity-conditional is added to the modal base. Sæbø’s new proposal for the analysis of the AC is that the antecedent without the information ‘you want’, called inner antecedent, is added to the ordering source. (shrink)

Many nongovernmental forms of business regulation aim at reducing ethical violations in commerce. We argue that such nongovernmental ethics standards, while often laudable, raise their own ethical challenges. In particular, when such standards place burdens upon vulnerable market participants (often, though not always, SMEs), they do so without the backing of traditional legitimate political authority. We argue that this constitutes a structural analogy to wars of humanitarian intervention. Moreover, we show that, while some harms imposed by such standards are desirable, (...) others are best thought of as a form of collateral damage. We thus look at the well-developed literature on just war theory for inspiration and find that the principles of jus ad bellum and jus in bello contain many insights that can be fruitfully adapted to the case of nongovernmental standard-setting. Consequently, we propose the Ius ad Normam—a set of principles that should guide would-be standard-setters in assessing whether imposing those burdens is ethically justifiable in particular cases. We also discuss how powerful multinational businesses often act simultaneously as standard-takers and standard-setters and explore the normative implications of this dual role. (shrink)

Frege explained the notion of generality by stating that each its instance is a fact, and added only later the crucial observation that a generality can be inferred from an arbitrary instance. The reception of Frege’s quantifiers was a fifty-year struggle over a conceptual priority: truth or provability. With the former as the basic notion, generality had to be faced as an infinite collection of facts, whereas with the latter, generality was based on a uniformity with a finitary sense: the (...) provability of an arbitrary instance. Elementary geometry can be axiomatized constructively by taking as primitive the concepts of the apartness of a point from a line and the convergence of two lines, instead of incidence and parallelism as in the classical axiomatizations. I first give the axioms of a general plane geometry of apartness and convergence. Constructive projective geometry is obtained by adding the principle that any two distinct lines converge, and affine geometry by adding a parallel line construction, etc. Constructive axiomatization allows solutions to (...) geometric problems to be effected as computer programs. I present a formalization of the axiomatization in type theory. This formalization works directly as a computer implementation of geometry. (shrink)

In conjunction with Iranian dualism this expectation was interpreted metaphysically: After the collapse of (...) the existing order God would create a messianic kingdom of peace and justice, that is, a kingdom under the direct rule of God. This was not “political progress” in the modern sense of the term, for the subject of these final events was God himself or God alone. Human beings might participate in accelerating or slowing down these divine actions by lawful or unlawful behavior—measured according to the Mosaic Law, but human historical acting itself would not lead to a betterment in this sense. Nevertheless, this form of thought gave history a direction, and this is what inspired later Jewish and Christian intentionality. Early Christianity was shaped by the expectation of the coming end of time in the immediate future; however, at the same time it added a remarkable tension to the traditional apocalyptic idea: the tension of fulfillment of time, which had happened already in the advent of Jesus as the Christ (messiah) and an expectation of the imminent completion of time (the return of Christ, which would finally end history and start the new kingdom). Since the second century ad this myth of future time became ontologized or platonized—that is, the future was transferred into an “other world.” This means that the new quality would not be a dimension of the future (only) but graspable in the ecclesiastical mediation of the sacraments. The eucharist was the pharmakon athanasias (medicine of immortality). At the same time there was a mystical dimension that holds that in a specific spiritual experience this dimension might be experienced by any person who would be prepared to receive it as divine grace. The paradigm of early Christianity failed: Christ did not return. There was no new kingdom that would have ended known history. In order to cope with this disappointment, two forms of life emerged that shaped the [End Page 159] spirit of Christianity throughout the Middle Ages, so to speak, until the end of the eighteenth century: ecclesiastical mediation of the saving reality and mystical participation in a transtemporal Beyondness.Utopia develops on the basis of difference between imagination and reality. At least structurally utopian thinking can be found in all cultures; usually it is expressed in the power of myths. This marks a difference between utopia and apocalyptics. There are three different types of utopian thinking: spatial, temporal, and in terms of different states of consciousness. Spatial utopia expects the final accomplishment or climax of history, that is, the essence of hope, in spatial terms, in different regions of the world, faraway, behind oceans or mountains (Atlantis, the country flowing with milk and honey, El Dorado, Shambhala, the islands of the blessed, etc.). These spaces lost their power of inspiring imagination because there are no more white spots on the map, and that is why this utopia had to emigrate into extraterrestrial spaces of the universe (the contemporary myths of ET, Star Wars, etc.)Temporal utopia transfers the field of expectation to the beginning of the world (paradise, Golden Age) or to the end of history (millennialistic thought, communistic utopia). Libertarians often rely on arguments that subordinate the principle of liberty to the value of its economic consequences. This invites the question of what a pure libertarian theory of justice—one that takes liberty as its overriding concern—would look like. Grotius's political theory provides a template for such a libertarianism, but it also entails uncomfortable commitments that can be avoided only by compromising the principle of liberty. According to Grotius, each person should be free to decide how to act as long (...) as her actions do not violate the equal liberty of others. According to this principle, however, people are free to enter any contract and alienate any rights, permitting even contracts of slavery or the alienation of rights of bodily integrity. Libertarians can escape this commitment to absolute freedom of contract only by adopting ad-hoc amendments to the principle of liberty. (shrink)

A proof-theoretical analysis of elementary theories of order relations is effected through the formulation of order axioms as mathematical rules added to contraction-free sequent calculus. Among the results obtained are proof-theoretical formulations of conservativity theorems corresponding to Szpilrajn’s theorem on the extension of a partial order into a linear one. Decidability of the theories of partial and linear order for quantifier-free sequents is shown by giving terminating methods of proof-search.

Over the last decade, theorists have persistently criticised the assumption that the International Criminal Court (ICC) can produce a noteworthy deterrent effect. Consequently, consensus has emerged that we should probably look for different ways to justify the ICC or else abandon the prestigious project entirely. In this paper, I argue that these claims are ill founded and rest primarily on misunderstandings as to the idea of deterrence through punishment. They tend to overstate both the epistemic certainty as to and the (...) size of the deterrent effect necessary in order to thus justify punishment. I argue that we should in general expect reasonably humane punitive institutions to lead to better consequences than if we abolish punishment entirely, and I show that, contrary to widespread assumption among critics of the ICC, we should not expect the conditions characteristically surrounding mass atrocity to undermine this presumption. Properly understood, the ICC equals adding another “slice of cheese” to our comprehensive crime preventive system modelled along the lines of James Reason’s Swiss cheese model of accident causation and risk management. Undoubtedly, some future perpetrators will elope through the holes in this layer too, but others will be deterred. (shrink)

According to both common wisdom and long-standing tradition, the ideal of peace is central to the morality of war. I argue that this notion is mistaken, not because peace is unachievable and utopian, though it might be for many of today’s asymmetrical conflicts; nor because the pursuit of peace is counterproductive, though, again, it might be for many of today’s conflicts; the problem, rather, is that the pursuit of peace is not a proper objective of war.

What if business leaders might pay attention to the (...) implications of their decisions for workers, communities, the environment, and others who are affected by their firm's actions, but economic theory encourages them to believe that they should – and in fact must – focus on getting every last dollar of profit possible?" (Nelson 2016: 184) -/- Ich lese diese Fragen von Nelson als einen Appell, die Theorie der Ökonomie umfassend auf ihre Tauglichkeit für unsere Lebenswirklichkeit zu hinterfragen. Zettel is a collection of fragments which Wittgenstein cut from various of his typescripts and preserved for future use. More than half of the fragments were written in the years 1946-1948, after the completion of Part I and before the composition of Part II of the Philosophical Investigations. This collection may therefore be regarded as a companion volume to the Investigations, adding to both the scope and the Unity of Wittgenstein′s chef d′oeuvre. The fragments were kept in a box and (...) were not strictly ordered. Many have marks showing changes and improvements made after they were cut from the typescripts; some have remarks added in handwriting. Editing the collection for publication was thus a task of considerable difficulty. Since Zettel was first published, further research has been carried out on the fragments and minute comparisons have been made with their typescript and manuscript sources, revealing certain inaccuracies and misinterpretations in the first editing of the work. The second edition corrects these shortcomings and includes new explanatory footnotes; a detailed index, compiled by Stephen Amdur, has also been added. (shrink)

The article analyses Finland’s and Norway’s female politicians’ war rhetoric with reference to the war in Afghanistan and contrasts it with Laura Bush’s rhetoric and feminism. In the Nordic countries the strong liberal and equity tradition of feminism could open up spaces for thinking differently about war, and yet the co-optation of hegemonic war rhetoric occurs in several ways. The ideograph ‘women-and-children’ is often evoked and added to the hegemonic foreign policy rhetoric without questioning the actual rhetorical work it does. (...) Gender-neutral rhetoric is used to hail into being a collective and unitary western do-gooder identity and to distance Nordic involvement from the US ‘war on terror’. The panegyric of UN Resolution 1325 facilitates the metamorphosis of the militaristic and masculine US-led NATO into a collective peacekeeper capable of saving ‘brown women from brown men’. (shrink)

According to what has become a standard history of quantum mechanics, von Neumann in 1932 succeeded in convincing the physics community that he had proved that hidden variables were impossible as a matter of principle. Subsequently, leading proponents of the Copenhagen interpretation emphatically confirmed that von Neumann's proof showed the completeness of quantum mechanics. Then, the story continues, Bell in 1966 finally exposed the proof as seriously and obviously wrong; this rehabilitated hidden variables and made serious foundational research possible. It (...) is often added in recent accounts that von Neumann's error had been spotted almost immediately by Grete Hermann, but that her discovery was of no effect due to the dominant Copenhagen Zeitgeist. We shall attempt to tell a more balanced story. Most importantly, von Neumann did not claim to have shown the impossibility of hidden variables tout court, but argued that hidden-variable theories must possess a structure that deviates fundamentally from that of quantum mechanics. Both Hermann and Bell appear to have missed this point; moreover, both raised unjustified technical objections to the proof. Von Neumann's conclusion was basically that hidden-variables schemes must violate the "quantum principle" that all physical quantities are to be represented by operators in a Hilbert space. According to this conclusion, hidden-variables schemes are possible in principle but necessarily exhibit a certain kind of contextuality. As we shall illustrate, early reactions to Bohm's theory are in agreement with this account. Leading physicists pointed out that Bohm's theory has the strange feature that particle properties do not generally reveal themselves in measurements, in accordance with von Neumann's result. They did not conclude that the "impossible was done" and that von Neumann had been shown wrong. (shrink)

Seine theologische Einführung sowie seine Darstellung sunnitischer Theologie wurden als Standardwerke über lange Zeit für die Ausbildung von Religionsgelehrten herangezogen. In diesem Band werden Taftazani Werke im Hinblick auf philosophische Einflüsse und innertheologische Debatten untersucht, wobei die Themenfelder Auferstehungslehre, Handlungstheorie und Schöpfungslehre im Mittelpunkt stehen. Damit bietet die Arbeit nicht nur neue Erkenntnisse über einen bisher kaum erforschten Gelehrten, sondern ermöglicht auch, Genese und Form (...) eines Standardwerks der klassischen islamischen Theologie nachzuvollziehen. Grundlage für die Wiedergabe des lateinischen Textes der Regulae und der Übersetzung dieses größten Fragments aus der Zeit vor Descartes’ Übersiedlung in die Niederlande ist die kritische Ausgabe von Giovanni Crapulli, La Haye 1966, die der schwierigen Überlieferungslage der erst postum aus dem Nachlaß (...) publizierten Schrift am ehesten gerecht wird; die von Springmeyer in seiner 1973 innerhalb der "Philosophischen Bibliothek" vorgelegten und seither mehrfach nachgedruckten Ausgabe des Textes vorgenommenen Eingriffe in die Textgestalt werden daher in dieser Neuausgabe nicht beibehalten. Gegenstand der Regulae und auch der "Cogitationes privatae" ist die Frage nach der Methode zur Erlangung sicherer Erkenntnis. In Descartes’ Philosophie bleibt die Frage nach der Methode durchgängig aktuell, auch dort, wo metaphysische, physikalische oder ethische Inhalte verhandelt werden. Und so verwundert es auch nicht, daß er das Manuskript der Regulae, an das er wohl 1628 zuletzt Hand angelegt hatte, noch 1649 mit auf seine letzte Reise nach Stockholm nahm, obwohl ihm 1637 mit dem anonym publizierten "Discours de la Méthode pour bien conduire sa Raison" bereits der große Durchbruch gelungen war und seine darin auf vier Regeln reduzierte Methode allgemeine Beachtung gefunden hatte. Die Reihe Islamkundliche Untersuchungen wurde 1969 im Klaus Schwarz Verlag begründet und hat sich zu einem der wichtigsten Publikationsorgane der Islamwissenschaft in Deutschland entwickelt. Die über 330 Bände widmen sich der Geschichte, Kultur und den Gesellschaften Nordafrikas, des Nahen und Mittleren Ostens sowie Zentral-, Süd- und Südost-Asiens.

In diesem Beitrag werden einige wissenschaftstheoretische Thesen u.a. von Paul K. Feyerabend hinsichtlich ad-hoc-Hypothesen untersucht. Es wird dabei gezeigt, dass Feyerabends Empfehlungen dafür, ad-hoc-Hypothesen zu akzeptieren oder abzulehnen, vom Einfluss dieser Hypothesen auf die Entwicklung von Technik abhängen. In einem weiteren Schritt wird angedeutet, dass eine derartige Relativierung auch in gängigen Bestätigungstheorien nahegelegt wird, dass man also gängigen Bestätigungstheorien und Feyerabend zufolge ad-hoc-Hypothesen nur hinsichtlich ihres Einflusses auf die Technikentwicklung akzeptieren oder ablehnen sollte.
